[1] Anthony Cacace was convicted on a one-count indictment of conspiracy to distribute cocaine hydrochloride in violation of 21 U.S.C. § 846. On direct appeal he asserted that an affidavit of application securing wiretap authorization did not comply with 18 U.S.C. § 2518(1)(c). This court found compliance and affirmed the conviction. United States v. Cacace, 5 Cir., 529 F.2d 1167 cert. denied, 429 U.S. 841, 97 S.Ct. 115, 50 L.Ed.2d 109Any person who attempts or conspires to commit any offense defined in this subchapter is punishable by imprisonment or fine or both which may not exceed the maximum punishment prescribed for the offense, the commission of which was the object of the attempt or conspiracy.
In contrast, 18 U.S.C. § 371, the general conspiracy statute, explicitly requires proof of an overt act in furtherance of the conspiracy as an element of the offense. That section provides, in pertinent part:
If two or more persons conspire . . . to commit any offense against the United States . . ., and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined not more than $10,000 or imprisoned not more than five years, or both.
